Order On order of the Court, the delayed application for leave to appeal is considered, and it is DENIED, because the defendant has failed to meet the burden of establishing entitlement to relief under MCR 6.508(D). The application is denied without prejudice to the defendant pursuing another motion for relief from judgment with the circuit court because it was never presented with the affidavits and arguments made in the delayed application that the defendant was entrapped, that trial counsel was ineffective for failing to pursue an entrapment defense, and that appellate counsel was ineffective for failing to seek a remand to develop a record on the ineffectiveness of trial counsel for not pursuing an entrapment defense. Cavanagh, C. J., would grant leave to appeal.
