Order On order of the Court, the delayed application for leave to appeal is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the trial court for an evidentiary hearing on defendant's claims of ineffective assistance of counsel and the prosecutor's alleged failure to comply with MCL 767.40a; MSA 28.980(1). In all other respects, the delayed application for leave to appeal is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court. We do not retain jurisdiction.
