Order On order of the Court, the application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we ORDER the Wayne County prosecutor to show cause in writing, in this Court, within 28 days after the date of this order, why that part of the trial court's order of sentence, which provides that the sentence in the instant case is to be served consecutively to a federal sentence which the defendant is presently serving, should not be vacated on the grounds that a consecutive sentence in such a case contravenes the rules set forth by this Court in In re Carey, 372 Mich 378 (1964), and People v. Gallagher, 404 Mich 429 (1979), and because MCL 333.7401(3); MSA 14.15(7401)(3), does not apply in the instant case because the defendant was sentenced in the instant case before he was sentenced in the federal case although he was, subsequently, resentenced in the instant case.
