Order On order of the Court, the application for leave to appeal and the motions for immediate consideration and for peremptory reversal are considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE that part of the Court of Appeals opinion which dismisses the defendant's appeal of right on the contingency of the trial Judge granting a new trial. The Court of Appeals is directed to issue an opinion on the merits in defendant's appeal of right within 60 days of the issuance of this order.
