On order of the Court, the delayed application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the June 17, 1986, judgment of the Court of Appeals and REVERSE the order of the Court of Appeals that denied the defendant's motion to remand. Since the defendant's motion to remand identified issues sought to be reviewed on appeal which should initially be decided the the trial Judge, the Court of Appeals should initially be decided by the defendant's motion to remand to the trial court. MCR 7.211(C)(1). We REMAND the case to the Court of Appeals which shall, while retaining jurisdiction, remand the case to the Saginaw Circuit Court for an evidentiary hearing on the defendant's allegation that he was denied the effective assistance of trial counsel. We do not retain jurisdiction.
